Parental responsibility is the set of rights, duties and decisions that parents have to protect the health, growth and education of their children. Child care. It starts at birth (or recognition) and continues even if the parents separate or divorce.

Guiding principle: every decision - of the parents or the judge - must focus on the pre-eminent interest of the son or daughter, evaluated on a case-by-case basis. Main regulatory references: articles 315-bis and 316 of the Italian Civil Code
