When a heterosexual couple is married, Italian law recognizes both spouses as parents of their son or daughter from birth. No act of recognition is necessary: the bond of affiliation is automatic for both of us. This means that mother and father immediately share parental responsibility (art. 316 of the Civil Code), that is, the duty and the right to care for, educate and represent the child. Marriage therefore guarantees full and immediate legal recognition to the parenting of both partners.
